(القسم الثالث: تداعيا عينًا في يَدِ غيرِهما، فإن ادَّعاها) مَن هي بيده (لنفسِه، حلف لكلِّ واحدٍ منهما يمينًا) لأن المدعيين اثنان، فوجب أن يحلف لكلِّ واحدٍ يمينًا.
