(فإنْ نَكَلَ) عن اليمين لكلٍّ منهما (أخَذَاها منه، و) أخذا منه (بَدَلها) لأن العين فاتت على أحدهما بترك اليمين للآخر (واقترعا عليهما) أي: على العين وبدلها؛ لأن المحكوم له بالعين غير مُعيّن، فوجبت القُرعة لتعيينه
