(وإن ادَّعى كلُّ واحدٍ) مِن اثنين على آخر (أنه باعني إيَّاه) أي: نحو العبد (بألفٍ، وأقامَ) بدعواه (بينةً؛ قُدِّم أسبقهما تاريخًا) لأن نَقْلَ الملك حاصل لمن سبق، فالعقد عليه بعدَه لا يصح.
