(إذا قال لعبده: متى قُتِلْتُ فأنت حُرٌّ، فادَّعى العبدُ أنه) أي: سيده (قُتِل، وأنكر ورثتُه، فالقول قولُهم إنْ لم تكن له بينةٌ) لأن الأصل عدم القتل.
