(وتُقدَّمُ بينةُ الحرِّ مع التعارض) أي: لو أقام الحُرُّ بينةً أن أباه مات بشعبان، والعتيق بينةً أنه مات بشوال؛ قُدِّمت بينةُ الحُرِّ؛ لأن معها زيادة علم.
