(الثالث: الكلام، فلا تُقبل شهادةُ أخرسَ، ولو فُهمت إشارتُه) لأن الشهادة يُعتبر فيها اليقين، ولذلك لا يُكتفى بإشارة الناطق، وإنما اكتُفي بإشارة الأخرس في أحكامه المختصَّة به؛ للضرورة (إلا إذا أدَّاها) الأخرس (بخطِّه) فَتُقبل.
