(وإذا حُكم بشهادة شهود الفَرْعِ، ثم رجعوا) عن شهادتهم (لزمهم الضمان) لأن الإتلاف حصل بشهادتهم، كما لو أتلفوا بأيديهم (ما لم يقولوا: بان) أي: ظهر (لنا كَذِب الأصول، أو غَلَطهم) لأن هذا القولَ منهم ليس برجوع عن الشهادة؛ لأنه لا يُنافي شهادة الأصول.
