(فإن تعذر) إخراجه بالكلية، أو لم يمكن إلا متقطعًا ونحوه (طمت) البئر (عليه) لتصير قبرًا له؛ لأنه لا ضرورة إلى إخراجه متقطعًا. وهذا حيث لا حاجة إلى البئر
