(ولو وصَّى بدفنه في ملكه، دفن مع المسلمين؛ لأنه) أي: دفنه بملكه (يضر الورثة) لمنعهم في التصرف فيه، فيكون منفيًا؛ لحديث:"لا ضررَ ولا ضرارَ".
