(إِلَّا وَليّ يتيم ومجنون) وسفيه (فيتعين عليه إخراج أدون مجزئ) أي: أقل الواجب، فيشتريه إن لم يكن في مال المحجور عليه طلبًا لحظِّه، ولا يعطي أسفل مع جبران، ولا أعلى ويأخذه
