(فلا يفطر غير قاصد الفعل، كمن طار إلى حَلْقه غبار ونحوه) كذُباب (أو ألقي في ماء فوصل إلى جَوفه، ونحوه) لأن غير القاصد غافل غير مكلَّف، وإلا، لزم تكليف ما لا يُطاق.
