(وله الفِطر بغلبة الظن) أن الشمس قد غربت؛ لأنهم أفطروا في عهده - صلى الله عليه وسلم - ثم طلعت الشمس . ولأن ما عليه أمارة يَدخله الاجتهاد، ويُقبَلُ فيه قول واحد كالقِبلة.
