(لكن لو مات بعد قُدرَته عليه) أي: على صوم الكفَّارة (وقلنا: الاعتبار بحالة الوجوب، وهو المذهب) كما يأتي توضيحه في كتاب الظِّهار (أُطعم عنه ثلاثة مساكين لكل يوم مسكين) في كفَّارة اليمين، قياسًا على قضاء رمضان.
