(ولا يصحُّ الاعتكافُ (٥) إلا بنيَّة) لحديث: "إنما الأعمَالُ بالنِّيَّاتِ" ولأنه عبادة محضة كالصوم. (فإن كان) الاعتكافُ (فرضًا) أي: منذورًا (لزِمَه نيَّةُ الفَرضيَّة) ليتميزَ المنذور عن التطوُّع
