(و) عليهما (القضاءُ على الفَوْر، ولو نَذرًا أو نَفلًا) لأنه لزم بالدخول فيه؛ ولأن من تقدم عن الصحابة لم يستفصلوا (إن كانا) أي: الواطئ والموطوءة (مكلَّفين) لأنهما لا عُذْر لهما في التأخير مع القُدْرة على القضاء
