(وإن كان) الأسير (صغيرًا، أو امرأة ولو راهبة، عاقبه) أي: القاتلَ (الأميرُ) لافتياته (وغرَّمه قيمته غنيمة؛ لأنه صار رقيقًا بنفس السبي) بخلاف الحُرِّ المقاتل.
