(ويحرم ردُّه) أي: الأسير المسلم (إلى الكفار، قال الموفق) والشارح (إلا أن يكون له) أي: الأسير المسلم (من يمنعه) من الكفار (من عشيرة ونحوها) فلا يمتنع رده؛ لأمنه.
