(وإن أسلمت بعده) أي: بعد الفتح عَنوة، سُلِّمت إليه، حرة كانت أو أَمَة، إذا كان مسلمًا؛ لأنه أمكن الوفاء بشرطه، فكان واجبًا؛ ولأن الإسلام بعد الأسر، فكانت رقيقة. (أو) أسلمت (قبله) أي: قبل الفتح (وهي أَمَة، سُلِّمت إليه) وفاء بشرطه
