(وإن فَضَل معه من الطعام ونحوِه) كالعلف (شيءٌ، ولو يسيرًا، فأدخله بلدَه في دار الإسلام، ردَّه في الغنيمة) لأنه إنما أُبيح له ما يحتاج إليه، فما بقي تبيَّنا أنه أخذ أكثر مما يحتاجه، فبقي على أصل التحريم.
