(وليس لأجيرٍ لحفظِ غنيمةٍ ركوبُ دابةٍ منها) أي: من الغنيمة؛ لأنه استعمال لها بما لا يقتضيه العقد (إلا بشرط) بأن شرط له الأميرُ ركوبَها إذا كانت معينة وعُيِّنت المسافة،
