(ومن استعار فرسًا، أو استأجره، أو كان) الفرس (حبيسًا، وشَهِد به الوقعة، فله سهمه) لأنه يستحق نفعه فاستحق سهمه. ويُعطى راكب الحبيس نفقة الحبيس من سهمه؛ لأنه نماؤه.
