(ولا يُحرَم) الغال (سهمَه) من الغنيمة؛ لأن سبب الاستحقاق موجود فيستحق، كما لو لم يغل، ولم يثبت حرمان سهمه في خبر، ولا يدلّ عليه قياس، فبقي بحاله
