(وإن كان ممن ضلَّ الطريق، أو حملته ريح في مركب إِلينا، أو شرد الينا بعض دوابهم، أو أبقَ بعض رقيقهم، فهو لمن أخذه غير مخمس) لأنه مباح ظهر عليه بغير قتال في دار الإسلام، فكان لآخذه كذلك، كالصيد.
