(وإن أسر كُفّارٌ مسلمًا فأطلقوه بشرط أن يقيم عندهم مدة أو أبدًا، لزمه الوفاء) لهم، نص عليه ؛ لقوله تعالى:{وَأَوْفُوا بِعَهْدِ اللَّهِ إِذَا عَاهَدْتُمْ}، ولقوله - صلى الله عليه وسلم -: "المسلِمُونَ عند (٣) شُروطِهم". فليس له أن يهرب.
