(ويكون العقد) أي: عقد الهُدنة (لازمًا) لا يبطل بموت الإمام، أو نائبه، ولا عزله، بل يلزم الثاني إمضاؤه؛ لئلا ينقض الاجتهاد بالاجتهاد، ويستمرُّ ما لم ينقضه الكفار بقتال أو غيره.
