(وإن هادنهم مطلقًا) بأن لم يقيد بمدة، لم يصحَّ؛ لأن الإطلاق يقتضي التأبيد، وذلك يفضي إلى تَرْك الجهاد بالكلية وهو غير جائز. (أو) هادنهم (مُعلِّقًا بمشيئة، كما: شئنا، أو شِئتم، أو شاء فلان، أو: ما أقركم الله، لم يصح) كالإجارة، ولجهالة المدة.
