(وإذا عقدها) أي: عقد الإمامُ الهُدنة (من غير شَرْط، لم يَجز لنا ردُّ من جاءنا مسلمًا أو بأمان، حرًّا كان أو عبدًا، رجلًا أو امرأة) لأنه ردٌّ لهم إلى باطل.
