(ويجب عقدُها إذا اجتمعتِ الشروطُ) السابق ذكرها، وتأتي أيضًا (ما لم يخف غائلةً منهم) أي: غدرًا بتمكنهم من الإقامة بدار الإسلام، فلا يجوز عقدُها؛ لما فيه من الضرر علينا.
