(وإذا تولى إمام فعرف قَدْر جزيتهم، أو قامت به بينة، أو كان) قَدْر جزيتهم (ظاهرًا، أقرَّهم عليه) لأن الخلفاء أقرُّوهم على ذلك، ولم يجددوا لمن كان في زمنهم عقدًا؛ ولأنه عقد لازم، كالإجارة، أو عقد بالاجتهاد، فلا ينقض.
