(ولو أُمِر الذمي بهدم بنائه) العالي (فبادر) الذِّمي (وباعه من مسلم) أو وهبه له، أو وقفه عليه، ونحوه، مما يخرجه عن ملكه (صح) البيع ونحوه (وسقط الهدم كما لو بادر وأسلم) لزوال المفسدة.
