(وإن لم يتقابضوا) من الطرفين أو أحدهما (فَسَخه) حاكمنا؛ لأنه لم يتمَّ، فنقض لعدم صحته (سواء كان قد حكم بينهم حاكمهم أوْ لا؛ لعدم لزومهم حكمه؛ لأنه لغو) لفقد شرطه، وهو الإسلام.
