(إلا الصغير المميز والسفيه، فيصحّ تصرُّفُهما بإذن وليهما ولو في الكثير) لقوله تعالى: {وَابْتَلُوا الْيَتَامَى} أي: اختبروهم، وإنما يتحقق بتفويض البيع والشراء إليهم.
