(واختار الموفَّق وجَمْعٌ) منهم الشارح والحارثي (صحته) أي: صحة قَبول هِبة ووصيَّة (من مميز) بلا إذن وليِّه (كعبدٍ) أي: كما يصح من العبد قَبول الهِبة والوصية بلا إذن سيده نصًّا . ويكونان لسيده.
