(ولو باع مُحِلٌّ صيدًا بشرط الخيار، ثم أحْرَم) البائع (في مدته) أي: الخيار (فليس له الفَسْخُ) لأنه ابتداء تملك للصيد في حال الإحرام، وهو غير جائز، لما تقدم في محظوراته ، وتقدم هناك عكس المسألة.
