قَالَ: (وَإِنْ نَكَلَ يَقْضِي عَلَيْهِ بِالنُّكُولِ) لِأَنَّ النُّكُولَ اعْتِرَافٌ وَإِلَّا يَحْلِفُ دَفْعًا لِلضَّرَرِ عَنْهُ وَقَطْعًا لِلْخُصُومَةِ، فَكَانَ نُكُولُهُ إِقْرَارًا أَوْ بَدَلًا فَيُقْضَى بِهِ.
