فصل اخْتِلَافُ الْبَائِعِ وَالْمُشْتَرِي في الثمن أو المبيع] فَصْلٌ (اخْتَلَفَا فِي الثَّمَنِ أَوِ الْمَبِيعِ فَأَيُّهُمَا أَقَامَ الْبَيِّنَةَ فَهُوَ أَوْلَى) لِأَنَّ كُلَّ وَاحِدٍ مِنْهُمَا مُدَّعٍ، وَقَدْ تَرَجَّحَتْ دَعْوَاهُ بِالْبَيِّنَةِ.
