قَالَ: (وَإِنْ كَانَ بِمَنَافِعَ عَنْ مَالٍ فَهُوَ كَالْإِجَارَةِ) لِوُجُودِ مَعْنَى الْإِجَارَةِ، وَهُوَ تَمْلِيكُ الْمَنَافِعِ بِمَالٍ حَتَّى تَبْطُلَ بِمَوْتِ أَحَدِهِمَا فِي الْمُدَّةِ كَمَا فِي صُورَةِ الْإِجَارَةِ
