(وَإِنْ شَاءَ اتَّبَعَ الْمَدْيُونَ بِنِصْفِهِ) لِبَقَاءِ حِصَّتِهِ فِي ذِمَّتِهِ ; لِأَنَّهُ لَمْ يَأْذَنْ لَهُ بِالدَّفْعِ إِلَى غَيْرِهِ، وَالدَّيْنُ الْمُشْتَرَكُ كَالْمَوْرُوثِ وَقِيمَةِ عَيْنٍ مُسْتَهْلَكَةٍ بَيْنَهُمَا وَثَمَنِ مَبِيعٍ وَنَحْوِهِ.
