قَالَ: (وَلَا تَنْعَقِدُ إِلَّا بِلَفْظِ الْمُفَاوَضَةِ) ; لِأَنَّ الْعَوَامَّ قَلَّمَا يَعْلَمُونَ شَرَائِطَهَا، وَهَذِهِ اللَّفْظَةُ تَتَضَمَّنُ شَرَائِطَهَا وَمَعْنَاهَا (أَوْ تَبْيِينُ جَمِيعِ مُقْتَضَاهَا) ; لِأَنَّ الْعِبْرَةَ لِلْمَعَانِي.
