قَالَ: (فَإِنْ مَلَكَ أَحَدُهُمَا مَا تَصِحُّ فِيهِ الشَّرِكَةُ صَارَتْ عِنَانًا) لِزَوَالِ الْمُسَاوَاةِ، وَذَلِكَ مِثْلَ الْإِرْثِ وَالْوَصِيَّةِ وَالِاتِّهَابِ، وَالْمُسَاوَاةُ فِي الْعِنَانِ لَيْسَتْ بِشَرْطٍ فَتَصِيرُ عِنَانًا لِوُجُودِ شَرَائِطِهَا
