قَالَ: (وَإِنِ اشْتَرَى أَحَدَهُمَا بِمَالِهِ ثُمَّ هَلَكَ مَالُ الْآخَرِ فَالْمُشْتَرَى بَيْنَهُمَا عَلَى مَا شَرَطَا) ; لِانْعِقَادِ الشَّرِكَةِ وَقْتَ الشِّرَاءِ (وَيَرْجِعُ عَلَى صَاحِبِهِ بِحِصَّتِهِ مِنَ الثَّمَنِ) ; لِأَنَّهُ اشْتَرَى لَهُ بِالْوَكَالَةِ وَنَقَدَ الثَّمَنَ مِنْ مَالِهِ فَيَرْجِعُ عَلَيْهِ لِمَا مَرَّ.
