الاختيار لتعليل المختارal-Mawsili

(وَعَلَيْهِ أُجْرَةُ بَغْلِ الْآخَرِ أَوْ رَاوِيَتِهِ) ; لِأَنَّهُ قَدِ انْتَفَعَ بِمِلْكِ الْغَيْرِ بِعَقْدٍ فَاسِدٍ فَيَلْزَمُهُ أُجْرَتُهُ.

قَالَ: (وَالرِّبْحُ فِي الشَّرِكَةِ الْفَاسِدَةِ عَلَى قَدْرِ الْمَالِ وَيَبْطُلُ شَرْطُ الزِّيَادَةِ) ; لِأَنَّ الرِّبْحَ تَبَعٌ لِرَأْسِ الْمَالِ فَيَتْبَعُهُ فِي الْمِلْكِيَّةِ، وَالزِّيَادَةُ إِنَّمَا تُسْتَحَقُّ بِالشَّرْطِ وَقَدْ بَطَلَ.
