(فَإِنْ شُرِطَ الرِّبْحُ لِلْمُضَارِبِ فَهُوَ قَرْضٌ) ; لِأَنَّ كُلَّ رِبْحٍ لَا يُمْلَكُ إِلَّا بِمِلْكِ رَأْسِ الْمَالِ، فَلَمَّا شَرَطَ لَهُ جَمِيعَ الرِّبْحِ فَقَدْ مَلَّكَهُ رَأْسَ الْمَالِ، ثُمَّ قَوْلُهُ مُضَارَبَةً شَرْطٌ لِرَدِّهِ فَيَكُونُ قَرْضًا
