(وَإِذَا خَالَفَ صَارَ غَاصِبًا) لِأَنَّهُ تَصَرَّفَ فِي مِلْكِ الْغَيْرِ بِغَيْرِ رِضَاهُ فَكَانَ غَاصِبًا، وَلَا تَصِحُّ إِلَّا بِمَا تَصِحُّ بِهِ الشَّرِكَةُ.
