الاختيار لتعليل المختارal-Mawsili

(فَإِنْ رَبِحَ عَتَقَ نَصِيبُهُ) ; لِأَنَّهُ مَلَكَ قَرِيبَهُ وَلَا ضَمَانَ عَلَيْهِ لِأَنَّهُ عَتَقَ بِالرِّبْحِ لَا بِصُنْعِهِ (وَيَسْعَى الْعَبْدُ فِي قِيمَةِ نَصِيبِ رَبِّ الْمَالِ) ; لِأَنَّ مَالِيَّتَهُ صَارَتْ مَحْبُوسَةً عِنْدَهُ فَيَسْعَى كَالْعَبْدِ الْمَوْرُوثِ إِذَا عَتَقَ عَلَى أَحَدِ الْوَرَثَةِ يَسْعَى فِي نَصِيبِ الْبَاقِينَ.
