قَالَ: (وَلَوِ اسْتَحَقَّ نِصْفَ الْهِبَةِ رَجَعَ بِنِصْفِ الْعِوَضِ) لِأَنَّهُ مَا عَوَّضَهُ بِهَذَا الْعِوَضِ إِلَّا لِيُسَلِّمَ لَهُ جَمِيعَ الْمَوْهُوبِ وَلَمْ يُسَلِّمْ إِلَّا نَصِفَهُ فَيَرْجِعُ بِنِصْفِ مَا عَوَّضَهُ
