(وَإِنْ هَلَكَتْ فِي يَدِهِ بَعْدَ الْحُكْمِ) بِالرَّدِّ (لَمْ يَضْمَنْ) ; لِأَنَّهُ أَمَانَةٌ فِي يَدِهِ حَيْثُ قَبَضَهُ لَا عَلَى وَجْهِ الضَّمَانِ.
