الاختيار لتعليل المختارal-Mawsili

(فَإِنْ نَقَصَ بِالزِّرَاعَةِ يَضْمَنُ النُّقْصَانَ) ؛ لِمَا مَرَّ، (وَيَأْخُذُ رَأْسَ مَالِهِ وَيَتَصَدَّقُ بِالْفَضْلِ) . مَعْنَاهُ: يَأْخُذُ مِنَ الزَّرْعِ مَا أَخْرَجَ عَلَيْهِ مِنَ الْبَذْرِ وَغَيْرِهِ، وَيَتَصَدَّقُ بِالْفَضْلِ.
