الاختيار لتعليل المختارal-Mawsili

قَالَ: (وَمَنْ ذَبَحَ شَاةَ غَيْرِهِ، أَوْ قَطَعَ يَدَهَا - فَإِنْ شَاءَ الْمَالِكُ ضَمَّنَهُ نُقْصَانَهَا وَأَخَذَهَا، وَإِنْ شَاءَ سَلَّمَهُ وَضَمَّنَهُ قِيمَتَهَا) ؛ لِأَنَّهُ إِتْلَافٌ مِنْ وَجْهٍ؛ لِتَفْوِيتِ بَعْضِ الْمَنَافِعِ مِنَ اللَّبَنِ وَالنَّسْلِ وَغَيْرِهِمَا، وَبَقَاءُ الْبَعْضِ وَهُوَ الْأَكْلُ، فَثَبَتَ لَهُ الْخِيَارُ كَمَا فِي الثَّوْبِ فِي الْخَرْقِ الْفَاحِشِ.
