قَالَ: (وَلَا يُبَاعُ، وَلَا يُوهَبُ، وَلَا يُتَصَدَّقُ بِهِ) ؛ لِلْجَهَالَةِ الْفَاحِشَةِ، وَعَدَمِ تَصَوُّرِ الْقَبْضِ. وَلِأَنَّهُ لَيْسَ بِمُتَقَوِّمٍ حَتَّى لَوْ سَقَى بِهِ غَيْرَهُ لَا يَضْمَنُ.
